What’s at issue: Whether Belk is negligent for packing boxes that an employee left on the floor next to a checkout counter at the Fashion Square store. According to the plaintiff’s complaint, the boxes were left in a shopping aisle and were not immediately visible to her as she walked by the checkout counter and tumbled over them, causing “serious and permanent bodily injuries.”

What’s at stake: $300,000. In addition to her physical injuries, Miller says Belk owes her for her physical pain, disfigurement and associated humiliation. Inconvenience, future medical expenses and loss of ability to transact business and household duties are also attributed to the rogue boxes.
What’s the status: The department store responded by denying much of the complaint and a jury trial has been set for August 25.
