Plaintiff: Kathleen E. Burg

Defendant: CVS of Virginia, Inc.

What’s at issue: Whether the drugstore on Long Street is responsible for Burg falling and injuring herself. According to her complaint, she went to CVS to pick up some photos and, when she turned to leave, caught her foot on “something protruding from under the counter.” Down plaintiff went, fracturing her right arm and shoulder.

What’s at stake: $500,000 in compensatory damages for things like lost wages and mental anguish. Perhaps most importantly, she has been “unable to perform all of the requirements of daily living or enjoy the normal activities of life.”

What’s the status: A trial date is set for September, but the case appears headed for mediation. Burg filed a complaint in Charlottesville Circuit Court in November, and CVS answered two weeks later denying it all.
