Cuccinelli urges the General Assembly to retain all gun regulation powers [VIDEO]

This week, C-VILLE wrote about UVA’s upgraded firearm regulation, which prohibits guns and concealed carries on university property. State Delegate David Toscano told C-VILLE that the newly enforceable regulation might start a tussle in the General Assembly when it reconvenes.

During a recent meeting with the Virginia Citizens Defense League (VCDL), Attorney General Ken Cuccinelli (whose opinion for Senator Emmett Hanger prompted the matter) seemed to echo Toscano’s sentiment.

"Back in 2006, we provided [former] Attorney General McDonnell a list of 14 items in the Virginia Administrative Code that banned the possession, carry, or discharge of firearms on state properties," said VCDL president Philip Van Cleave. "And we couldn’t find any statutory justification for that." Van Cleave then proposes changing the administrative code (which has the force of law) to a statute, so that the General Assembly would be required to give enforceable authority to such a decision.

"First of all, the General Assembly certainly can bring right back to itself all authority over all gun regulation if they chose to do so," said Cuccinelli. "To put it simply from my perspective, I wish they would." The assembly’s pre-file deadline for new legislation is December 5.
