Plaintiff: Cindy Baker

Defendant: Wal-Mart

What’s at issue: Whether Wal-Mart is responsible for an unattended ladder that “tipped over, slid off and struck” Baker while she was bent over in a store aisle grabbing an item off the lowest shelf, according to her complaint. Baker charges Wal-Mart in Albemarle County Circuit Court with all sorts of negligence, including failing to exercise reasonable precaution under the circumstances and, most significantly, failing to remove the ladder.

What’s at stake: $2.5 million. Baker claims to have suffered serious injuries including physical pain, discomfort and mental anguish as a result of the ladder crashing down on her.

What’s the status: The initial complaint was filed less than a month ago. Wal-Mart has not yet responded.
